Welcome to WakeSlap. These Terms of Service ("Terms") govern your access to and use of the WakeSlap website, mobile application, and related services (collectively, the "Services"). By using WakeSlap, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. Who We Are

WakeSlap ("WakeSlap," "we," "us," or "our") provides an alarm and wake-up experience through its website and mobile application.

2. Eligibility

You must be at least 13 years old to use WakeSlap. If you are under the age of majority where you live, you may only use the Services with permission from a parent or legal guardian.

3. Use of the Services

You agree to use WakeSlap only for lawful purposes and in compliance with these Terms.

You agree not to:

  • Violate any law or regulation
  • Interfere with the operation or security of the Services
  • Attempt unauthorized access to any part of the Services
  • Copy, modify, distribute, reverse engineer, or exploit any part of the Services except as allowed by law
  • Misuse WakeSlap content, branding, audio, screenshots, or other intellectual property
  • Upload or transmit malicious code, spam, or harmful material

4. App Features and Availability

WakeSlap may offer free and paid features. We may update, modify, suspend, or discontinue features at any time without notice.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

5. Purchases and Subscriptions

If WakeSlap offers in-app purchases or subscriptions, those transactions may be processed by Apple, Google, or another third-party platform. Billing, renewals, cancellations, and refunds are governed by the terms and policies of the platform handling the transaction.

6. Intellectual Property

All content and materials in the Services, including text, graphics, logos, designs, software, screenshots, audio, video, trademarks, and branding, are owned by or licensed to WakeSlap and protected by applicable intellectual property laws.

You may not use our content without our prior written permission, except as permitted by law.

7. User Submissions

If you send us feedback, ideas, creator applications, reviews, or other submissions, you grant WakeSlap a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, display, and distribute that content for the purpose of operating, improving, and promoting the Services, subject to applicable law.

You represent that you have the right to submit that content.

8. Third-Party Services

WakeSlap may contain links to third-party websites, tools, or app stores. We are not responsible for third-party content, services, or privacy practices.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available." To the fullest extent permitted by law, WakeSlap disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

WakeSlap is intended as an entertainment and utility product. We do not guarantee that the app will wake every user in every circumstance or function perfectly on every device.

10. Limitation of Liability

To the fullest extent permitted by law, WakeSlap and its owners, affiliates, employees, contractors, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to the Services.

To the fullest extent permitted by law, WakeSlap's total liability for any claim related to the Services will not exceed the greater of:

  • The amount you paid to WakeSlap, if any, in the 12 months before the claim arose, or
  • $100 USD

11. Indemnification

You agree to defend, indemnify, and hold harmless WakeSlap and its affiliates, personnel, and partners from and against claims, liabilities, damages, losses, and expenses arising out of or related to your misuse of the Services, your submissions, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or if necessary to protect the Services, users, or our rights.

13. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in Washington, and you consent to their jurisdiction and venue.

14. Changes to These Terms

We may update these Terms from time to time. If we do, we will post the updated version on this page and revise the "Last updated" date above. By continuing to use the Services after changes become effective, you agree to the revised Terms.
